1. Acceptance
By accessing or using the 3PM website, products, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
2. Services
3PM provides a connected construction technology ecosystem of SaaS products, including role-specific apps (App 1 through App 7), 3PM Escrow, and related services. Our products operate on a freemium model with free and paid subscription tiers. Services are powered by 3PM Auth (authentication and subscription management at idp.3pm.app and signup.3pm.app), Workspaces, and Buddy AI.
3. Account and Registration
You must create an account to use certain Services. You may register directly or via social login (Facebook, Google, LinkedIn). You agree to provide accurate, current information and to keep your account secure. You are responsible for all activity under your account.
4. Subscription and Billing
Our products offer free and paid subscription tiers. Paid plans may include AI usage as part of the plan; limits, overages, and billing for AI usage are specified in each product's pricing. By subscribing to a paid plan, you agree to pay all applicable fees. Fees are billed in advance (monthly or annually) and are generally non-refundable unless otherwise stated or required by law.
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. We reserve the right to change pricing with reasonable notice.
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Use the Services to transmit malware, spam, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Resell or redistribute the Services without authorization
- Use the Services in a way that could harm, disable, or overburden our infrastructure
We may suspend or terminate your access if we believe you have violated these terms.
6. Intellectual Property
3PM and its licensors own all rights to the Services, including software, design, and content. You receive a limited, non-exclusive license to use the Services for their intended purpose. You retain ownership of content you create or upload; by submitting content, you grant us a license to use, store, and process it as needed to provide the Services.
7. AI Features
Our Services include AI-powered features (e.g., Buddy AI, content generation, recommendations). AI outputs are assistive and advisory in nature. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You are responsible for reviewing and verifying any AI output before relying on it. Use of AI features may be subject to usage limits as part of your subscription plan.
8. Termination
We may suspend or terminate your account and access to the Services at any time for violation of these Terms or for any other reason. You may terminate your account at any time. Upon termination, your right to use the Services ceases. We may retain certain data as described in our Privacy Policy.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3PM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. Dispute Resolution
These Terms are governed by the laws of Australia. Any dispute arising from these Terms or the Services shall be resolved in the courts of Australia. You agree to attempt to resolve disputes informally before initiating formal proceedings.
11. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via email or in-product notice. Continued use of the Services after changes constitutes acceptance of the revised Terms.
